Terms and Conditions
These terms and conditions of services apply to the provision of services of GLOBALEXPEDITION YACHT RENT, S.A. DE C.V.
1. Services
GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. Fulfilling its corporate purpose, it is dedicated, among other activities, to provide tourist services, such as: giving and / or renting pleasure boats, such as yachts, boats, catamarans, kayak, sailboats, jet skis and in general. Any vessel that can navigate the water. Motor vehicles including recreational vehicles such as off-road vehicles, tubulars, ATVs and any other land vehicle.
GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. will provide the services to the Client in exchange for the previously agreed fee, and in accordance with their Lease Agreement that includes these Terms and Conditions as a reference. 2. Payment
2.1 Billing. The invoices for Services, provided according to the contracted services, will be issued at the end of the month in which the contracted rental or service was made. 2.2 Any breach by "THE LEASEHOLDER" regarding the payment of the price or the deposit of the guarantee in the agreed terms and deadlines will automatically determine the ineffectiveness of the contract, without prejudice to the amounts that "THE LEASEHOLDER" may have delivered at the time of the breach will remain the property of GLOBALEXPEDITION YACHT RENT, S.A. 3. Confidentiality
3.1 Confidential information. Both parties guarantee that all information, which is or should be confidential in nature, that they receive from the other party will remain confidential, unless a legal obligation requires disclosure of such information. The party receiving confidential information should only use it for the purpose for which it was provided. The information should be considered confidential as long as either party designates it as such.
4. Warranty
4.1 Professionalism. GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. declares and guarantees that the Services that GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. provides should be done in a professional and efficient manner.
4.2 GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. guarantees that the contract services, to which the legal instrument refers, are carried out with the necessary expertise and professionalism since this guarantees the satisfaction of "THE LEASEHOLDER". 5. Limitation of liability
5.1 Damages. Which, but not limited to, are described below, drowning, sprains, strains, fractures, cold and / or heat injuries, chronic fatigue, injuries involving vehicles, animal bites and / or stings, or by contact with corals, hedgehogs, poisonous plants, heart attacks, the possibility of being permanently paralyzed and / or death, and assumes full responsibility for all risks derived from the activities contracted to GLOBALEXPEDITION YACHT RENT, S.A. 5.2 Danger. You agree to comply with the terms and conditions of your participation. 5.3 Waiver. By your own right and on behalf of your heirs, assignees, personal representatives and /or closest relatives, YOU WAIVE, RELEASE, DOWNLOAD AND AGREE NOT TO SUE GLOBALEXPEDITION YACHT RENT, S.A. 6. Term and termination
6.1 Term. This Contract will be effective during the term that has been defined in the Leasing contract.
6.2 Reservation. Once the reservation is made, "THE LEASEHOLDER" is obliged to pay the agreed price, even in the event that, for any reason, he is unable or renounces to carry out the projected journey If the withdrawal occurs in periods of less than 48 hours to the date of shipment, "THE LEASEHOLDER" must comply with the obligations established in this contract, without any right to be reimbursed the amounts that may have been delivered.
7. General
7.1 Law applicable to this Contract. This Agreement will be interpreted and applied in accordance with Mexican law. Any conflict that may arise in relation to this Contract will be within the jurisdiction of the state of Veracruz.
7.2 Assignment. The Lessee cannot transfer or assign her interest in the Contract to third parties.
7.3 Personnel and subcontracting. GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. It will decide, at its sole discretion, which personnel are responsible for performing the Services. GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. You have the right to subcontract the Services, in whole or part of them, to other entities or third parties, provided that GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. continue to guarantee the Services referenced in this Agreement.
7.4 Force majeure. In the event that, due to force majeure, including the failure of the boat, it cannot be delivered, GLOBALEXPEDITION YACHT RENT, S.A. DE C.V. undertakes to inform "THE LEASEHOLDER" immediately, as well as to use all humanly possible means to solve the problem and / or try to find another rental boat of the same or higher category.
7.5 Validity. The clauses of this Agreement that are intended to survive the expiration or termination of this Agreement, including, but not limited to, the Confidentiality, Limitation of Liability and Compliance with the law clauses, shall survive the expiration and termination of the Agreement.
The parties declare that they ratify these Terms and Conditions in each and every one of its parts, adding that there is no fraud or bad faith; Likewise, the parties agree that for the interpretation and fulfillment of the present ones, they submit to the competence and jurisdiction of the Judicial Courts of the city of Veracruz, Veracruz.
